Judges L. Mark Bailey, Cale J. Bradford, and Paul D. Mathias will hear Fort Wayne Patrolmen's Benevolent Association and Michaeline Jones v. City of Fort Wayne, Ind., No. 02A05-0807-CV-424, on appeal from Allen County.
The Patrolmen's Benevolent Association and Officer Michaeline Jones appealed the trial court's order denying their motion for summary judgment and granting Fort Wayne's motion for summary judgment. Jones, who participates in the city's Home Fleet Vehicle Policy, suffered non-fracture injuries in the accident and sought reimbursement for her out-of-pocket medical expenses from the city. The city denied her request because it claimed she was off duty when the accident happened.
On appeal, Jones argues the city should be held liable for injuries she suffered as a result of her accident at the end of her shift because she was injured "while performing her duty" as an officer pursuant to Indiana Code Section 36-8-4-5.
Arguments begin at 1:25 p.m. in the Little Theater Room in the high school, 7802 Hague Road, Indianapolis.
