Judges Carr Darden, Michael Barnes, and Cale Bradford will hear arguments in Marvin A. Smith v. State of Indiana, No. 49A05-0905-CR-256, at 1:30 p.m. in the Little Theater of Lawrence North High School, 7802 Hague Road.
Marvin Smith is appealing his convictions of Class C felony robbery, Class D felony criminal recklessness and Class A misdemeanor failing to stop following an accident, and the finding he is a habitual offender. Smith argues the state failed to show property was taken from the CVS he allegedly robbed or that he was the person who demanded property from the pharmacy.
Smith also appeals his aggregate sentence of 18 years in prison with six years suspended to probation.
