On July 31, the majority of justices decided to deny James Kindred, et al. v. Betty Townsend, et al., 64A04-1101-PL-42. The Court of Appeals previously affirmed the grant of Harmon Crone’s motion for relief from judgment in a complaint brought by James, Thomas and Sam Kindred against Betty Townsend to quiet title. The Kindreds added Crone as a defendant.
Justice Frank Sullivan dissented in a separate opinion as to why he would grant transfer. He believed the plaintiffs were denied their right to have each issue presented on appeal addressed and disposed of by the Court of Appeals.
