The following Indiana Supreme Court opinions were issued after IL deadline Thursday.
Sidney Lamour Tyson v State of Indiana
45S03-1509-CR-528
Criminal.
and
State of Indiana v Scott Zerbe
49S05-1509-MI-529
Miscellaneous/interlocutory appeal. Rules sex offenders who are required to register in other states and who move to Indiana are required to register in Indiana, regardless of the date of the offense. Holds people who fail to do so may be charged with failure to report. There is no ex post facto violation in instances where offenders required to report to another state’s sex offender registry are charged with failing to report to the Indiana Sex Offender Registry when they move to the state. Doing so does not place an additional burden on the offender, and Indiana’s statute revised in 2006 imposes no additional punishment.
