Boone County Prosecutor Todd Meyer announced his decision Tuesday, saying 21-year-old Anthony Baumgardt of Lebanon should “face the ultimate consequence.” Baumgardt faces murder and other charges for the March 2 death of Deputy Jacob Pickett, who was shot while chasing of Baumgardt with his police dog.
Meyer said during a news conference that Baumgardt’s behavior since his arrest contributed to his death penalty decision. Baumgardt said outside court last month that he fired the shots because he didn’t want to be bit by the officer’s dog and he had “no remorse.”
Defense attorney Allan Reid didn't immediately return a phone message seeking comment.
