The Local Rules Advisory Committee for the Northern District has offered amendments regarding the scope and modification for Local Rules 1-1, 3-1, 5-1 and 7-1. Local Rule 5-2 would be completely deleted.
First, proposed changes to Local Rule 1.1 would insert language stating that local civil rules would govern all civil and criminal cases pending before the district court, excluding criminal cases inconsistent with local criminal rules. The changes also state the court may apply former local civil and criminal rules respectively if it finds that applying the amendment would not be feasible or would be unjust in cases pending when an amendment takes effect.
Amendments to Local Rule 3-1 dealing with divisional revenue would include language addressing proper and improper venue, as well as waivers. The word “served’ would be inserted into Local Rule 5-1 in regard to requirements for electronic filing.
Lastly, amendments to Local Rule 7-1 would provide consistency with Fed. R. Civ. P. 15(a) by allowing 21 days to respond to Rule 12(b), (e), and (f) motions.
