Damon Stepp v. Covance, Inc.

Appeal from the United States District Court for the Southern District of Indiana, Indianapolis Division. Senior Judge Sarah Evans Barker.
Civil. Vacates the entry of summary judgment in favor of Covance, Inc. against Damon Stepp in his retaliation and discrimination lawsuit. Finds a reasonable jury could conclude that Covance refused to promote Stepp to permanent status because of his complaints. Remands.
Vanessa Mathews v. REV Recreation Group, Inc.

Appeal from the United States District Court for the Northern District of Indiana, Fort Wayne Division. Judge William C. Lee.
Civil. Affirms the grant of summary judgment to REV Recreation Group, Inc., against Vanessa and Randy Mathews. Finds the Mathewses have not shown that REV failed to honor its warranties or that the warranty provisions on an RV the couple purchased were unconscionable.

Robert Worden v. State of Indiana (mem. dec.)

Criminal. Affirms Robert Worden’s eight-year sentence for conviction of Level 5 felony battery by means of a deadly weapon and Class A misdemeanor driving while suspended. Finds Worden has not sustained his burden of establishing that his sentence is inappropriate in light of the nature of the offenses and his character.
Matthew Streit v. State of Indiana (mem. dec.)

Affirms Matthew Streit’s conviction of Level 6 felony theft. Finds the Bartholomew Circuit Court did not abuse its discretion by failing to find Streit’s guilty plea as a mitigating factor.
Clarence Boris Miller v. State of Indiana (mem. dec.)

Criminal. Affirms Clarence Miller’s conviction of murder, Level 3 felony aggravated battery and his firearms sentencing enhancement. Finds the Vanderburgh Circuit Court did not abuse its discretion in admitting the hearsay statement and that there was sufficient evidence to support Miller’s convictions.
Richard Brown v. State of Indiana (mem. dec.)
18A-CR-2545
Criminal. Affirms Richard Brown’s conviction of two counts of Level 4 felony dealing in a narcotic drug. Finds any error in admission of challenged evidence to be harmless. Also finds the admission of the evidence did not affect Brown’s substantial rights.
