Indiana Supreme Court
C.S., Jr. v. State of Indiana; Z.T. v. State of Indiana
19S-JV-136, 19S-JV-137
Juvenile. Affirms the orders from Elkhart Circuit Court making C.S. Jr., and Z.T. wards of the Indiana Department of Correction. Finds the trial court did not follow Indiana Administrative Rule 14(B) when it had the juveniles participate in their modification hearings via Skype, but concludes the juveniles failed to demonstrate fundament error. Justice Steven David dissents, arguing the trial court’s failure to follow Administrative Rule 14(B) resulted in fundamental error, so the lower court’s ruling should be reversed and the case should be remanded.

Indiana Court of Appeals
S.A.W. v. K.L.W. (mem. dec.)
19A-DR-1002
Domestic relations. Affirms the denial of Scott Weaver’s motion to modify child custody, parenting time and child support, as well as the grant of Kelli Weaver’s request to relocate with their child, L.W. Finds there is evidence in the record to support the Henry Circuit Court’s decision to grant mother’s request to relocate and deny father’s motion to modify custody. Also finds the trial court’s judgment was not clearly erroneous.

Marcus Lamont Weston v. State of Indiana (mem. dec.)
19A-CR-1023
Criminal. Affirms Marcus Weston’s 13-year sentence for his conviction of Level 3 felony aggravated battery. Finds the sentence is not inappropriate, but remands for clarification as to whether the Lake Superior Court intended to include a recommendation regarding Weston’s therapeutic community participation and, if so, for correction of the sentencing order and abstract of judgment.

Jennifer M. Culver v. State of Indiana (mem. dec.)
18A-CR-2661
Criminal. Affirms Jennifer Culver’s conviction of Level 6 felony theft. Finds sufficient evidence to support the conviction.
