Civil tort. Affirms dismissal of a lawsuit in Marion Superior Court alleging IU Health employees falsified Santos Cortez’s medical records in a medical malpractice complaint that was settled. Holds that claims regarding the alleged alteration of Cortez’s medical records fall within the scope of the Medical Malpractice Act and therefore should have been first submitted to a medical review panel.
In the Matter of the Adoption of I.B. (Minor Child): J.P. v. V.B.

Adoption. Reverses a Hamilton Superior adoption decree and its order that mother J.P’s consent was not required for the adoption of her minor child, I.B., by the child’s stepmother. Holds that the trial court’s findings are unsupported and do not support its conclusions that mother abandoned the child or knowingly failed to pay child support when required and able to do so.
Parkview Hospital Inc v. American Family Insurance

Civil plenary. Affirms in part the Allen Superior Court’s denial of American Family Insurance’s motion for summary judgment. Reverses, however, the trial court’s denial of Parkview’s motion for summary judgment. Remands.

Juvenile. Affirms Tippecanoe Superior Court’s ruling to terminate the parental rights of mother S.R. Finds the Indiana Department of Child Services provided sufficient evidence to support the trial court’s finding that mother was noncompliant with drug screens until August 2019. Rules the trial court’s unchallenged findings support its conclusions under which the child was removed from mother’s care would not be remedied.
