The Estate of Sandra King by Special Administrator Marie Briggs v. Aperion Care d/b/a Aperion Care Tolleston Park and Steve Robertson, Insurance Commissioner for the Indiana Department of Insurance
19A-MI-3037
Miscellaneous. Reverses the Lake Superior Court’s denial of the estate of Sandra King’s motion to compel arbitration. Finds the trial court erred in its denial and remands with instructions for the trial court to enter an order granting the estate’s motion to compel.
Jeremy Ross v. State of Indiana
20A-CR-561
Criminal. Affirms Jeremy Ross’ aggregate 10-year sentence with seven years suspended for conviction of Level 2 felony methamphetamine dealing, Level 3 felony methamphetamine possession, and Class A misdemeanor marijuana possession. Finds that the Marion Superior Court did not erroneously admit the statements Ross made to a police officer because they were allegedly obtained in violation of Miranda. Also finds sufficient evidence to support the convictions. Judge Paul D. Mathias concurs in a separate opinion.
Dustin B. Crabtree v. State of Indiana
19A-CR-2128
Criminal. Affirms Dustin Crabtree’s conviction of Level 1 felony child molesting and 50-year sentence imposed by the Ripley Circuit Court. Finds the court did not err in admitting a statement made to officers and the sentence is not inappropriate.
Joseph W. Kruger v. State of Indiana (mem. dec.)
20A-CR-797
Criminal. Affirms Joseph Kruger’s aggregate 40-year sentence for conviction in Tippecanoe Superior Court of Level 3 felony armed robbery, Level 3 felony attempted armed robbery, and two counts of Level 5 felony robbery. Finds nothing about either the nature of Kruger’s offenses or his character as an offender makes his sentence an outlier that needs to be revised.
