Nicholas M. Elliott of Indianapolis and Michael P. Rehak of South Bend were indefinitely suspended in separate orders issued Thursday by the Indiana Supreme Court. Elliott is facing two discipline cases while Rehak is facing one.
According to both orders, the now-suspended lawyers failed to respond to show-cause orders from the Indiana Supreme Court and requests for ruling and to tax costs filed by the Indiana Supreme Court Disciplinary Commissions. Both suspensions took effect immediately and will continue until “the Executive Director of the Disciplinary Commission certifies to the Court that Respondent has cooperated fully with the investigation or until further order of this Court, provided there are no other suspensions then in effect.” Also, both lawyers most fulfill the duties of a suspended attorney under Admission and Discipline Rule 23(26).
Elliott must pay $513.80 in the costs of the proceedings while Rehak must pay $521. All justices concurred in both orders. The orders do not specify the nature of the conduct that gave rise to investigations of grievances against the attorneys.
The Indiana Roll of Attorneys shows that Rehak has been the subject of two disciplinary actions since he was admitted to the Indiana bar in 1986. Elliott was admitted in 2010 and has been the subject of nine actions.
