However, the lawyer is still unable to practice law in Indiana.
Nicholas M. Elliott remains under a suspension in case number 20S-DI-639, but his noncooperation suspension in case number 20S-DI-638 was terminated in a Feb. 16 order.
Elliott was suspended Feb. 4 after failing to cooperate with the investigations by the Indiana Supreme Court Disciplinary Commission and for failing to respond to show-cause orders from the Indiana Supreme Court. He was assessed $513.80 for the costs of prosecuting case 20S-DI-638.
“On February 12, 2021, the Executive Director of the Disciplinary Commission filed a ‘Certification of Compliance,’ stating that Respondent has now cooperated with its investigation. Pursuant to Admission and Discipline Rule 23(10.1)(c)(3), the suspension from the practice of law imposed in this case terminated as of the date the certification was filed,” the order signed by Chief Justice Loretta Rush says.
“The Court therefore ORDERS that Respondent’s suspension from the practice of law in this case only be shown terminated as of February 12, 2021.”
According to the Indiana Roll of Attorneys, Elliott was admitted to the practice of law in Indiana in 2010. He has been the subject of nine disciplinary actions.
