Miscellaneous. Affirms the Henry Circuit Court’s denial of Jeffrey Gene Garrison’s request for immediate release from the Department of Correction after his parole was revoked, finding Garrison’s claims are either meritless or waived.

Darci Wilson v. Anonymous Defendant 1 (mem. dec.)

Civil tort. Affirms summary judgment for Anonymous Defendant 1 in a medical malpractice suit alleging negligence for an injury Darci Wilson alleges she suffered during a rehabilitation session with a physical therapist. Finds the St. Joseph Superior Court possessed subject matter jurisdiction to reach a preliminary determination on issues of law and fact before it, and because the designated evidence indicates no genuine issues of material fact and Anonymous is entitled to judgment as a matter of law and is not liable under the theory of respondeat superior.

Post conviction. Affirms the denial of Samuel Jackson’s petition for post-conviction relief, finding the Allen Superior Court did not abuse its discretion in its ruling on his requests for judicial notice, and in denying his motions for discovery requests and to set an evidentiary hearing.

Termination: K.R., et al. v. Indiana Department of Child Services (mem. dec.)

Juvenile termination of parental rights. Affirms the termination of mother K.R. and father L.M.’s parental rights to their child L.M. Finds neither parent’s due process claims were violated, the Vanderburgh Superior Court did not err in its admission of evidence and the court’s decision with regard to father was not clearly erroneous.

Hollie Ann Detweiler v. Steven D. Detweiler (mem. dec.)

Domestic relation, no children. Affirms the Randolph Circuit Court’s denial of Hollie Ann Detweiler’s request for incapacity maintenance from ex-husband Steven Detweiler, finding no error under the circumstances.
