Subscribe NowIndiana Supreme Court justices are set to hear oral argument in two cases next week, including a dispute that split an appellate panel earlier this year over a breached insurance contract and a Scott County murder-for-hire.
In Clark County REMC v. Glenn Reis, Dale Bottorff, Jimmie Sanders, Steve Stumler, 21S-CT-00343, four former board of directors of the Clark County rural electric membership corporation, also known as REMC, sued and argued the REMC breached its contract by vacating its longtime policy that had provided qualifying longtime directors post-retirement healthcare benefits.
The Clark Circuit Court entered summary judgment for the directors on their breach-of-contract claim and a divided Indiana Court of Appeals panel affirmed. However, a dissenting judge found that the majority engaged in a “logical fallacy” in holding that the utility was obligated to continue providing coverage to the plaintiffs.
Justices granted transfer and agreed to hear the case during arguments scheduled for 9 a.m. EDT on Oct. 7 at the Indiana Supreme Court courtroom in Indianapolis.
The high court will also hear oral argument in Johnetta Ruth Hall v. State of Indiana, 20S-LW-00660. There, Johnetta Hall was found guilty of murder and conspiracy to commit murder. She was sentenced by a special judge in the Jennings Circuit Court to life in prison without parole for murder and a concurrent 35-year sentence for conspiracy.
On appeal, Hall challenges the sufficiency of the evidence and makes arguments related to the use of a co-conspirator’s deposition testimony. She also requests that the Supreme Court reduce her sentence for conspiracy.
Argument in that case will be held at 10 a.m. EDT on Oct. 7 at the Indiana Supreme Court courtroom.
