The following 7th Circuit Court of Appeals opinion was posted after IL deadline on Monday:
Lawrence Karisa Kithongo v. Merrick B. Garland, Attorney General of the United States
21-2662.
Petition for Review of an Order of the Board of Immigration Appeals.
Dismisses for lack of jurisdiction Lawrence Kithongo’s applications for adjustment of status under 8 U.S.C. § 1255,and withholding of removal under U.S.C. § 1231(b)(3)(A). Finds it could not evaluate the denial of the application for adjustment of status because the immigration judge denied the application as a matter of discretion and Kithongo failed to identify a legal or constitutional issue. Rules it is beyond the jurisdiction of the appellate court to reweigh the factors the immigration judge considered in denying the withholding of removal claim. Denies Kithongo’s petition for review under the Convention Against Torture, 8 C.F.R. §§ 1208.16, 1208.17, 1208.18. Holds Kithongo waived his arguments for relief under the CAT because he failed to contest immigration judge’s decision before the Board of Immigration Appeals.
