Subscribe NowAn Indianapolis attorney who had been on probationary status following a drug conviction has been suspended from the practice of law for at least 275 days starting Sept. 15 without automatic reinstatement.
The order revoking probation and suspending Grant E. Helms in In the Matter of Grant E. Helms, 21S-DI-262, was issued Friday by the Indiana Supreme Court.
Helms was suspended in May 2021, but his suspension was stayed after 90 days and he was required to serve a 24-month probation.
In June, the Indiana Supreme Court Disciplinary Commission filed a Verified Notice of Probation Violation, pursuant to Admission and Discipline Rule 23(16)(c). The commission asserted Helms tested positive for methamphetamine in March 2022.
According to the disciplinary complaint filed in May 2021, Helms was arrested in May 2020 by an Indianapolis Metropolitan Police Department officer and charged with possession of methamphetamine, a Level 6 felony. He entered a plea agreement that reduced his conviction to a Class A misdemeanor.
The commission found that by committing a criminal act, Helms had violated Indiana Rule of Professional Conduct 8.4(b).
According to the order, Helms acknowledged his probation violation and asked to continue his probationary period with additional requirements. But the Supreme Court concluded the revocation of probation was warranted and the attorney must serve the balance of his time on suspension.
At the end of his suspension, after he has paid the costs of the proceeding, fulfilled the duties of a suspended attorney and satisfied the requirements for reinstatement of Admission and Discipline Rule 23 (18)(b), Helms may petition for reinstatement.
