IN Supreme Court amends section for deposition rules of trial procedure

The Indiana Supreme Court has amended the Rules of Trial Procedure regarding depositions.

The changes, which were announced Wednesday and are effective Jan. 1, are to subsections C and F of Rule 30 on Depositions Upon Oral Examination.

Under Subsection C, on Examination and cross-examination—Record of examination—Oath–Objections, the justices struck the phrase “under the provisions of Rule 43(B)” from the first sentence. The full sentence now reads, “Examination and cross-examination of witnesses may proceed at the trial.”

Subsection F, under Certification on Filing—Exhibits—Copies, removed the pronoun “he” and “him” and replaced it with “the officer” and “the person.”

The section also added, “If each party participating in the deposition agrees to the original deposition being certified electronically, the officer shall send the electronic certified original transcript endorsed with the title of the action and marked ‘Original Deposition of (here insert name of witness)’ and shall promptly electronically deliver it to the party taking the deposition.”

Chief Justice Loretta Rush issued the order, with all justices concurring.
