Juvenile. Affirms and reverses in part J.G.’s adjudication as a delinquent for what would be Level 4 felony child molesting, Level 5 felony criminal confinement and Level 6 felony dissemination of matter harmful to minors if committed by an adult. Finds the admission of hearsay testimony was harmless. Also finds insufficient evidence supports the Marion Superior Court’s true finding on the Level 6 felony. Finally, finds the scrivener’s error should be corrected. Remands with instructions to correct the scrivener’s error.

David E. Voelkert v. State of Indiana (mem. dec.)

Criminal. Affirms the St. Joseph Superior Court’s finding that David Voelkert was in indirect contempt. Finds the trial court’s imposition of the maximum 180-day sentence was not unreasonable. Also finds there was no abuse of discretion.

Juvenile termination of parental rights. Affirms the termination of father G.C.’s parental rights to his four minor children. Finds no error in the termination of G.C.’s parental rights or a violation of due process.

Jhonna K. Parra v. State of Indiana (mem. dec.)

Criminal. Affirms Jhonna K. Parra’s seven-year sentence for Level 3 felony robbery resulting in bodily injury. Finds Parra has not shown that her sentence is inappropriate in light of the nature of the offense and her character.

Anthony Thurman v. State of Indiana (mem. dec.)
23A-CR-1659
Criminal. Affirms Anthony Thurman’s eight-year sentence for Level 6 felony auto theft and Level 4 felony attempted burglary. Finds Thurman’s sentence is not inappropriate.
