Indianapolis law firm sues landlord for poor building conditions

An Indianapolis-based law firm is suing its landlord after claiming the owner failed to address asbestos and water damage issues in the building.

Keffer Hirschauer LLP filed the lawsuit against Indiana Continuing Legal Education Forum Inc. in the Marion County Commercial Court on Wednesday.

The firm claims it has reported multiple instances where leaking water pipes have dropped debris and materials into the office space of the company.

In March 2024, a pipe in the ceiling overheated and ruptured, releasing gallons of scalding water into the law firm. Since then, the firm has not been able to fully use the building.

In addition, the firm says that during a partial remediation process, the landlord found lead paint and asbestos in the building. However, the landlord has still not told Keffer Hirschauer if any testing has been done to determine how much is in the building, according to the lawsuit.

Further, the firm says the air conditioning in the building began to fail in April 2024, and by mid-April, the temperature of the building exceeded 90 degrees Fahrenheit in some areas.

Keffer Hirschauer is seeking compensatory damages from the landlord, asking not to be required to pay rent for the duration of the lease term and requesting the lease be terminated because the building is not available for its intended use.
