Three finalists selected for Allen Superior Court vacancy

The Allen County Judicial Nominating Commission announced Wednesday afternoon three finalists for an upcoming vacancy on the county superior court due to a retirement.

The names of Magistrate Judges Brian D. Cook, Jason C. Custer and Michael Douglass were forwarded to Gov. Eric Holcomb for consideration. The governor has 60 days to make his selection.

The new appointee will succeed Allen Superior Court Judge David Avery. That person will serve the remainder of Avery’s term, which ends Dec. 31, 2028.

Avery was appointed by Gov. Frank O’Bannon in 2000 and then re-elected four times. In May, he announced his intent to retire at the end of this year.

He currently handles requests for conditional driving privileges, allowing individuals with suspended licenses to drive to work, doctor’s appointments and other essential services.

The nominating commission led by Indiana Supreme Court Justice Christopher Goff honored Avery before interviewing the six candidates who applied for the opening.

Avery received a framed certificate from the Indiana Supreme Court Justices recognizing his 24 years of service.

The other three candidates who interviewed for the judicial vacancy were Kevin Mitchell, David M. Lutz and Michael A. Barranda.
