United States of America v. Taibian Harris
24-1163
Criminal. Appeal from the United States District Court for the Northern District of Indiana, South Bend Division. Judge Damon Leichty. Affirms the district court’s finding that Taibian Harris recklessly created a substantial risk of death or serious bodily injury to another person in the course of fleeing from a law enforcement officer under U.S.S.G. § 3C1.2. Finds there is ample evidence to support the district court’s finding that Harris was knowingly fleeing from law enforcement. Also finds no error in the district court’s careful assessment of Treveon Smith’s credibility as a witness. Attorneys for appellee: David Hollar, Eli Temkin. Attorney for appellant: Donald Schmid.

Mental health. Affirms Marion Superior Court Judge David Certo’s temporary involuntary civil commitment order for T.G.
