Civil tort. Affirms Hamilton Superior Court Judge David Najjar’s denial of Georgia Miller’s motion in limine and his jury instruction. Finds Miller’s challenge to the motion in limine is waived. While the appellate court does find the former instruction erroneous, it concludes the trial court’s instructions do not constitute reversible error under the circumstances of the case.
