Shawn Laver Perry v. State of Indiana

Criminal. Affirms Shawn Perry’s conviction in Lake Superior Court for criminal confinement. Finds sufficient independent evidence supported Perry’s conviction for criminal confinement. Also finds that because of the trial court’s clear intent to vacate Counts 2 and 5, the case should be remanded with instructions to correct the abstract of judgment. Remands to trial court with instructions the abstract should reflect Perry’s standing convictions for criminal confinement, intimidation and domestic battery. Attorney for appellant: Sean Mullins. Tylor N. Kooistra v. State of Indiana

Criminal. Affirms Tylor Kooistra’s conviction in Allen Superior Court for Level 6 felony pointing a firearm and his ensuing two-year sentence. Finds Kooistra’s sentence is not inappropriate, due to his extensive criminal history. Also finds Kooistra’s post-trial challenges to the trial court’s revocation of his pretrial release are moot. Edward Harrill v. Karen Harrill

Domestic relations with children. Affirms Dearborn Circuit Court Special Judge Jeffrey Sharp’s judgment dissolving the marriage of Edward Harrill and Karen Harrill. Finds the trial court did not err in concluding the energy accounts were part of the marital estate because Edward Harrill failed to list them as his separate property in the premarital agreement. Also finds the trial court did not err in concluding the loan debt was his responsibility alone. Further, finds the trial court did not err in determining Karen Harrill signed the premarital agreement without coercion and also did not err in determining that the agreement was not unconscionable. Zotec Partners, LLC, and Medical Management Professionals, LLC. V. G. Darrell Hulsey and CBIZ Operations, Inc.

Civil plenary. Reverses Marion Superior Court Senior Judge Heather Welch’s judgment in favor of (and awarding damages to) CBIZ Operations, Inc. on its counterclaim against Zotec Partners. Finds the trial court’s judgment against Zotec on CBIZ’s counterclaim rests entirely upon its clearly-erroneous finding that Zotec had sued CBIZ for violating a nonexistent contractual provision. Remands with instructions to enter judgment in favor of Zotec on CBIZ’s counterclaim. Also finds that the trial court correctly determined that Zotec was not entitled to have its IUSA claim tried to a jury and that the trial court correctly did not revisit factual matters that had already been determined by a jury in the subsequent bench trial on Zotec’s IUSA claim.
