Grande v. Marion County Sheriff

Court & Case no.: U.S. District Court, Southern District of Indiana, No. 08-CV-0183

Injuries: nerve damage to right arm during fingerprinting a fractured arm

Date: Sep. 16 – 18, 2009

Judge or Jury Trial: Jury Trial

Judge: Hon. Richard Young

Disposition: Verdict for plaintiff against Marion County Sheriff in the amount of $120,000; verdict for
City of Indianapolis against plaintiff

Plaintiff Attorney(s): A. Waples, Waples & Hanger

Defendant Attorney(s): Alex Will and Jon Mayes, City of Indianapolis, Corporation Counsel

Case Information: Plaintiff Becky Grande was arrested on a bench warrant following a car accident in which
she broke her right arm. She was treated at Wishard Hospital with a temporary splint and told she needed surgery to repair
the fracture. She was then released without surgery and transferred to the Arrestee Processing Center, where she was fingerprinted.
During the fingerprinting, her radial nerve was damaged, causing her to lose control of the movement of her wrist. Surgery
was later required to restore movement of her wrist.
