Judges Edward Najam Jr., Carr Darden, and L. Mark Bailey will hear Mario Brown v. State of Indiana, No. 49A02-1008-CR-905, at 11 a.m. at Jeffersonville High School. Mario Brown appeals the denial of his motion for additional credit time. He claims that Indiana Code Section 35-38-2.6-6, amended effective in 2010 to permit good time credit for home detention, is remedial in nature and should be applied to him. He also argues that the denial of retroactive application of the amended statute violates his equal protection rights.
