Subscribe NowThe Indiana Court of Appeals has accepted an interlocutory appeal addressing whether a southern Indiana prosecutor should be able to stay on the third triple-murder trial of former Indiana State Police trooper David Camm.
Spencer Circuit Judge Jonathan Dartt ruled in January that Floyd County Prosecutor Keith Henderson should be able to continue prosecuting the case, despite a book deal that he had arranged on the case, but cancelled after the Indiana Supreme Court in June 2009 ordered a new trial. Defense attorneys argued it was a conflict of interest requiring his removal, and that’s the issue the appellate court on March 11 decided to hear.
The case is on hold while the appeal is pending. Camm has been twice convicted of the September 2000 murders of his wife and two young children, ages 5 and 7. The Court of Appeals overturned Camm’s first conviction and the Indiana Supreme Court two years ago reversed it again.
This latest appeal is likely to spawn a new request for the state’s highest court, before it ultimately is allowed to proceed at the local level for trial in Spencer County.
