The Office of the Indiana Attorney General has asked the Indiana Supreme Court to take the Indiana Recount Commission’s appeal of the finding that Secretary of State Charlie White was ineligible to be on the November 2010 ballot.

In December, Marion Circuit Judge Lou Rosenberg reversed the Recount Commission’s decision that White was eligible to run for office, but stayed his ruling pending an appeal. The AG’s office, which is representing the commission, filed the motion Monday to have the high court directly take the case, with an appeal brief being filed later. The Supreme Court had not ruled on the motion as of Wednesday morning.
