A $50 filing fee on mortgage foreclosure actions that expired Jan. 1 would be renewed for two years under legislation that advanced this week in the Indiana House of Representatives.

The House Judiciary Committee on an 8-2 vote sent HB 1308 to the full House for consideration. The bill would require county clerks to continue to collect a $50 mortgage foreclosure counseling and education fee to be deposited in the home ownership education account within the state’s general fund.

HB 1308 would require that clerks collect the fee through Jan. 1, 2015. Fees from the home ownership education fund are used to support education, foreclosure counseling, programs to facilitate settlement conferences, pro bono legal services and authorized nonprofits, among other things.

HB 1308 is sponsored by Rep. Woody Burton, R-Greenwood.
