A Barnes & Thornburg LLP attorney was arrested over the weekend on suspicion of drunken driving in Hamilton County.

Marietto “Mario” V. Massillamany, 36, was pulled over on 96th Street in Hamilton County at around 7:30 a.m. Sunday by Hamilton County sheriff’s deputy Matt Snively. An operating while intoxicated investigation was conducted, and Massillamany was arrested for OWI with a previous conviction, which is a Class D felony, and Class C misdemeanor OWI with a blood alcohol concentration between 0.08 and 0.15, according to information from the sheriff’s office.

Massillamany, of Fishers, was charged with two drunken-driving offenses in March of 2010 while spokesman for the Marion County Prosecutor’s Office. He pleaded guilty to Class A misdemeanor OWI endangering a person, and the second charge of Class A misdemeanor operating a vehicle with an alcohol concentration equivalent to 0.15 or more was dismissed.

Massillamany’s driver’s license was suspended and he was ordered to complete probation and community service as part of his sentence.

He resigned from the prosecutor’s office after the arrest and was publicly reprimanded by the Indiana Supreme Court in May 2011. As part of his discipline, Massillamany executed a monitoring agreement with the Indiana Judges and Lawyers Assistance Program.

Massillamany also is chair of the Hamilton County Young Republicans.

The Hamilton County Prosecutor’s Office had not filed charges by IL deadline.
