The city filed a complaint Monday in a Marion County court against the Indiana Department of Homeland Security, saying the agency’s opposition inhibits the city’s ability to complete the project.
The state agency opposes the project because it claims Kokomo is violating the terms of a federal hazard mitigation grant it accepted for a flood-prone area where the stadium would be built. The Federal Emergency Management Agency grant program requires the city to maintain the land along Wildcat Creek as open green space.
Flooding in April 2013 damaged more than 300 homes in Kokomo. The Indiana Attorney General's Office says it’s reviewing the lawsuit.
