Subscribe NowThe Indiana Court of Appeals Thursday upheld the 65-year sentence and convictions a jury rendered against an Indianapolis man who robbed, shot and killed a pizza deliveryman at a southside apartment complex.
A Marion Superior jury convicted Shawn Wilson of killing Papa John’s deliveryman Daniel Jaffke and stealing his Jeep on Jan. 31, 2014. Judge Kurt M. Eisgruber consolidated some charges to avoid double-jeopardy concerns and imposed the 65-year term.
The Court of Appeals panel rejected Wilson’s claims on appeal that the trial court abused its discretion in preventing Wilson from cross-examining a witness on prior inconsistent statements, and that another witness heard a third person say he and Wilson had committed the crime.
"We agree that Wilson did not make the requisite showing of unavailability and the hearsay statements were, therefore, inadmissible," Chief Judge Nancy Vaidik wrote for the panel in Shawn Wilson v. State of Indiana, 49A02-1409-CR-673. "Wilson additionally argues that the evidence is insufficient to sustain his convictions. Finally, Wilson challenges several aspects of his sentence. Finding no error, we affirm Wilson’s convictions and sentence."
