Subscribe NowA judge has reduced to 10 years the sentence of a northern Indiana man convicted of felony murder in a home break-in after the Indiana Supreme Court threw out the murder convictions of three co-defendants.
The attorney for 20-year-old Jose Quiroz, Kathleen Cleary, says he might be eligible for release from prison as early as October after Elkhart Circuit Judge Terry Shewmaker modified his conviction to a charge of burglary Thursday under an agreement with prosecutors.
Quiroz pleaded guilty in 2013 in the shooting death of 21-year-old Danzele Johnson of Goshen by a homeowner during a 2012 burglary. Co-defendants Blake Layman, Anthony Sharp and Levi Sparks successfully appealed their murder convictions to the Indiana Supreme Court, and Shewmaker resentenced them last month on burglary charges.
Only Quiroz had pleaded guilty.
