State of Indiana v. Wallace Irvin Smith, III

Criminal. Affirms grant of Smith’s petition for alternative misdemeanor sentencing. Indiana Code 35-50-2-7(d) (2014) permits the trial court to modify his sentence and the language in Smith’s plea agreement did not preclude it.

William A. Connor v. State of Indiana
03A05-1511-CR-1893
Criminal. Affirms 14-year sentence following guilty plea to Class B felony criminal deviate conduct, with four years suspended to probation. Connor has not met his burden of persuading the court that his sentence is inappropriate in light of the nature of the offense (forcing his adoptive sister to participate in sexual conduct) and his character. Judge Najam concurs in result.
