WLFI-TV reports that a Howard County judge granted dismissal of the 19 felony counts Dr. Marilyn Wagoner had faced Tuesday after prosecutors filed a motion to dismiss those charges.
Prosecuting attorney Mark McCann's motion said the 79-year-old Wagoner is unable to stand trial based on her physician's assessment. She lives in an assisted living facility, suffers from mental incapacity, memory loss and declining cognitive functions.
Police say Wagoner Clinics in Burlington and Kokomo were overprescribing painkillers that led to numerous patient overdoses and deaths.
Marilyn Wagoner is the wife of Dr. Don Wagoner, who was sentenced in July 2014 to two years in prison for felony charges in connection with the case.
