Warrick County Prosecutor Mike Perry said Tuesday that if 22-year-old Isaiah Hagan is convicted in Halee Rathgeber's murder prosecutors would then have to prove to jurors that he allegedly robbed or tried to rob the 20-year-old when she was slain.
Jurors could then recommend life in prison without parole for Hagan based on that aggravating circumstance.
The Evansville Courier & Press reports Hagan faces a felony murder charge alleging he killed Rathgeber while robbing the University of Southern Indiana student of her wallet and other items.
Rathgeber was found dead in April from a gunshot to the head near a rural sports complex about 15 miles from Evansville.
