Judges John Baker, Paul Mathias and Terry Crone will hear the case of Robert Ryan Fleming v. State of Indiana, 09A05-1703-CR-00645 Tuesday in Fort Wayne. Robert Fleming was convicted of Class A misdemeanor intimidation and Class B misdemeanor disorderly conduct after screaming at and threatening his neighbors and police officers who were called to the scene. Specifically, Fleming threatened to beat his neighbor for harboring his girlfriend, who had fled his home in fear, and threatened to rape police officers’ wives if they did not mind their business and get off his property.
Fleming now argues on appeal that the state failed to prove he intended to place his neighbor in fear of retaliation or that he engaged in a true threat. The state counters that Fleming did engage in a true threat of physical violence against his neighbor.
The arguments will be held 1 p.m. Tuesday at the University of St. Francis Performing Arts Center, 431 W. Berry St., Fort Wayne, 46802.
