Criminal. Affirms Delmar Kelly’s dealing in narcotics conviction. Finds the Hendricks Superior Court did not commit fundamental error in allowing the state to present during trial evidence of Kelly’s post-arrest, pre-Miranda silence. Also finds Kelly’s due process rights were not violated.

Shannon Graves v. State of Indiana (mem. dec.)

Criminal. Affirms the Madison Circuit Court’s order requiring Shannon Graves to serve the balance of his sentence for his conviction of burglary and theft in the Indiana Department of Correction after violating his probation. Finds that the same sanction would be imposed on Graves even if his burglary finding was erroneous.

Criminal. Affirms Tracy Meloy’s conviction of Class A misdemeanor domestic battery. Finds there is sufficient evidence to support the conviction.

Mark F. Johnson v. State of Indiana (mem. dec.)

Civil plenary. Affirms the Allen Superior Court’s denial of Mark Johnson’s post-conviction relief from his conviction of Class A felony burglary. Finds the post-conviction court did not err by rejecting Johnson’s local-rule claim.
