A retrial is planned after a jury couldn’t reach a verdict in the trial of a man charged in the death of a man found stabbed on a sidewalk in eastern Indiana.

The Palladium-Item reported a Dec. 18 trial date has been set for James Dean Childers in the January 2017 death of Austin Sparks. Authorities say Childers and Sparks had been in a confrontation shortly before Sparks was found stabbed near a tavern. Sparks died at a hospital.

Childers was arrested about a week after Sparks was stabbed.

Childers’ defense attorney, Keirian A. Brown, argued during the murder trial this month in Wayne County Circuit Court that another man stabbed Sparks.
