Yusuf Hotep-El v. State of Indiana

Criminal. Affirms the Marion Superior Court’s termination of Yusuf Hotep-El’s self-representation. Finds the trial court did not err when it terminated Hotep-El’s self-representation in order to determine his competency to stand trial. Also finds the trial court was correct in not reinstating Hotep-El’s pro se status based on the conclusion that he sought to use the courtroom for deliberate disruption of the proceedings.
Marques D. Trice v. State of Indiana
18A-CR-697
Criminal. Reverse the Marion Superior Court’s order to destroy Marques Trice’s handgun. Finds Trice’s conviction of carrying a handgun without a license does not amount to a conviction of misuse of a firearm, so the court erred by ordering the destruction of Trice’s handgun. Remands. Judge Terry Crone dissents in a separate opinion.
Christopher S. Goble v. State of Indiana (mem. dec.)
18A-CR-1414
Criminal. Affirms the Howard Superior Court’s revocation of Christopher Goble’s probation and the imposition of his previously suspended sentence. Finds the trial court had statutory authority to revoke probation. Also finds there is sufficient evidence to support the revocation.
Sean M. Keith v. State of Indiana (mem. dec.)
18A-CR-112
Criminal. Affirms Sean Keith’s conviction for Level 6 felony residential entry. Finds that Keith failed to establish fundamental error. Also finds the jury’s exposure to certain evidence did not make “a fair trial impossible.”
