Subscribe NowThe Indiana Judicial Conference Board of Directors and Court Alcohol and Drug Program Advisory Committee are seeking public comment on proposed amendments to rules for court-administered alcohol and drug programs.
Amendments have been proposed for sections 19, 22, 27, 30 and 31 to the rules, and the creation of a new section concerning chemical testing has also been proposed. The new chemical testing section, which would be added as Section 33, would provide that if a program drug tests its clients, the policy and procedure for drug testing must conform to the requirements of the section.
Also, proposed amendments to Section 31, concerning substance abuse education standards, would restrict education curricula to two national companies providing evidence-based education courses. Additionally, the amendments would add new language requiring CADPAC to provide programs with a list of approved substance abuse education courses and would give programs two years from the amendment date to provide CADPAC with a list of approved courses. Any programs not on the approved curricula list for review by CADPAC could be submitted for review to the Indiana Office of Court Services.
Additional proposed changes include the removal of the requirement that programs have referral agreements with treatment providers when they refer 10 or more clients in a year to that provider. However, newly drafted commentary to Section 27(e), which previously required referral agreements, encourages programs to continue entering into referral agreements as a best practice.
