In May 2024, Jacob Agee was sentenced to seven years in prison, with two years suspended, for operating a vehicle while intoxicated and causing death in a May 2023 crash.
Investigators with the Indianapolis Metropolitan Police Department reported that 32-year-old Kiara Jenkins was killed on May 19, 2023, while driving on 30th Street in Indianapolis, according to WTHR.
Police said Agee drove through a red light at 30th and Meridian Street, crashing into Jenkins’ car.
Agee’s blood alcohol level was found to be at 0.18%, more than two times over the legal limit in Indiana, according to court documents.
He could not be reached for Indiana Lawyer’s request for comment before Monday’s deadline.
In August 2024, Agee was suspended immediately from practicing law in the state because he was found guilty of a crime punishable by a felony.
His resignation from the bar of the state of Indiana is effective immediately as of Dec. 19, according to Indiana Supreme Court Chief Justice Loretta Rush.
Any further attorney disciplinary proceedings against Agee are dismissed as moot because of his resignation.
Agee’s resignation only removes him from the practice of law; it does not relieve him of any liability he has for misconduct under civil or criminal law.
Agee is ineligible to petition for reinstatement to the practice for five years. If he seeks reinstatement, the misconduct in his affidavit of resignation and any other allegations may be addressed in the reinstatement process.
Approval of a petition for reinstatement requires “clear and convincing evidence of the petitioner’s remorse, rehabilitation, and fitness to practice law,” Rush wrote.
According to the Roll of Attorneys, Agee was admitted to the bar in 2010.
