Indiana Supreme Court to review case in which appellate court ruled company should have warned firefighters beforehand

The Indiana Supreme Court granted the transfer of a case last week in which a firefighter was injured while responding to a call.

The appellate court reversed the summary judgment order in favor of the company that leased the building in October 2023. Allen Superior Court had previously found that Richard Dolsen’s claims were barred by Indiana’s firefighter rule.

Dolsen fell through an opening in the wall down into a stairwell while looking for a ventilation opening and electrical breaker box by touching and pressing the inside wall to guide him.

The question of whether he should have been warned of the opening in the wall beforehand won him the reversal.

Now, the case Richard Dolsen Jr. v. Veoride Inc. et al., 24S-CT-225, will be considered by the high court.

The justices did not decide on any other transfer petitions last week.
