Indianapolis doctor weighing legal options following reprimand, fine for discussing 10-year-old’s abortion

The legal team for Indianapolis OB-GYN Dr. Caitlin Bernard says it is “exploring all options,” including legal options, after the Indiana Medical Licensing Board found she violated patient privacy laws by talking publicly about an abortion she performed on a 10-year-old rape victim from Ohio.

“As we await the written decision in this case, we are exploring all options for our next steps including using all legal tools possible,” Alice Morical and the legal team at Hoover Hull Turner LLP said in a statement Wednesday. Morical was part of the team that represented Bernard before the board last week during a hearing on an administrative action filed by Republican Attorney General Todd Rokita.

The board reprimanded and fined Bernard $3,000 based on the privacy violation but rejected accusations from Rokita that she violated state law by not reporting the child abuse to Indiana authorities. The board also declined to suspend Bernard’s medical license.

The board has 90 days following the May 25 meeting to issue a written opinion. Once that happens, each side has 30 days to appeal in Marion Superior Court.
