Appeal from the United States District Court for the Southern District of Indiana, Indianapolis Division. Senior Judge Sarah Evans Barker.
Civil. Affirms the Indiana Southern District Court’s issuance of a preliminary injunction on behalf of Whole Woman’s Health Alliance, as modified in accordance with the 7th Circuit Court of Appeals’ opinion. Finds the Alliance has shown a likelihood of success on the merits of its undue burden challenge. Also finds no clear error in the district court’s conclusion that Indiana did not give Alliance’s licensing application “a fair shake.”

Michael Andrew Ray v. State of Indiana (mem. dec.)

Criminal. Affirms Michael Ray’s conviction for Class A felony attempted dealing methamphetamine, finding sufficient evidence to support that conviction. Also affirms the admission of text message evidence and the Orange Circuit Court’s denial of Ray’s request to dismiss a juror or his for-cause challenge of another, finding no abuse of discretion. Also finds a double jeopardy violation in Ray’s convictions for Class A misdemeanor and Class D felony resisting law enforcement. Remands with instructions for the trial court to vacate Ray’s Class A misdemeanor conviction and sentence.
Christian Bulmer v. Sara L. Olson (mem. dec.)

Domestic relations. Dismisses Christian Bulmer’s appeal of the Franklin Circuit Court’s order dissolving his marriage to Sara Olson. Finds Bulmer’s appeal stems from an interlocutory order, so he is not entitled to appeal the order as a matter of right. Also finds there is no indication that Bulmer sought certification from the trial court or permission from the Indiana Court of Appeals to file a discretionary interlocutory appeal, and he has not stated a statutory right to appeal.
