Anthony Graff v. State of Indiana

Criminal. Affirms Dearborn Circuit Court Judge F. Aaron Negangard’s denial of Anthony Graff’s motion to suppress. Finds Graff’s statements were made voluntarily. Reverses the trial court’s grant of the state’s motion in limine, which was seeking to exclude evidence of the administration of the polygraph examination and any expert testimony related to it. Finds Graff should be allowed to present evidence regarding the polygraph examination. Remands for the trial court and parties to define the presentation of the evidence. Bruce Cutler v. State of Indiana

Criminal. Affirms Bruce Cutler’s Class A misdemeanor battery resulting in moderate bodily injury. Finds Marion Superior Court Magistrate Peggy Hart did not engage in improper burden shifting in rejecting Cutler’s claim of self-defense. Also finds the state presented sufficient evidence to negate Cutler’s claim of self-defense. Attorney for appellant: Tyler Helmond. Alice M. Flowers v. State of Indiana
