Criminal. Affirms Madison Circuit Court Judge Mark Dudley’s denial of Aron Smith’s request for new court-appointed counsel. Finds the trial court did not abuse its discretion or violate Smith’s right to counsel under the United States or Indiana Constitutions when it allowed Smith to dismiss trial counsel from his case and denied his request for a new court-appointed attorney. Also finds the trial court did not abuse its discretion when it declined Smith’s request for additional testimony on the matter. Attorney for appellant: Mark Leeman. Leah Moone v. State of Indiana

Criminal. Affirms Marion Superior Court Judge Jennifer Harrison’s sentence of Leah Moone to 1,460 days for stalking and 180 days for invasion of privacy, and Harrison’s order that the sentences be served consecutively for an aggregate sentence of 1,640 days. The court also suspended 365 days of Moone’s sentence for stalking. Finds Moone’s communications with R.M. were true threats and thus not protected by the First Amendment to the United States Constitution. Also finds the state presented sufficient evidence that Moone committed Level 5 felony stalking of R.M. and Class A misdemeanor invasion of privacy against E.H.
