Christopher Richardson v. State of Indiana

Criminal. Affirms Christopher Richardson’s convictions for two counts of Class A felony child molesting and one count of Class C felony child molesting. Finds no reversible error occurred when the Union Circuit Court allowed a forensic interviewer to testify that the victim did not exhibit any signs of coaching because the interviewer’s testimony was cumulative of the unobjected-to testimony of the detective assigned the case. Reverses the trial court’s imposition of two 30-year sentences to run consecutively for the Class A felonies. Finds the trial court erred in the sentencing because it did not enumerate any aggravating factors to support the imposition of consecutive sentences. Remands for resentencing.

Criminal. Affirms and reverses in part George D. Shanklin’s sentence to an aggregate of 21 years for his convictions of several controlled-substance-related offenses, and for being a habitual offender. Finds the sentencing transcript demonstrates unequivocally that the Adams Superior Court directed that Shanklin would serve his misdemeanor sentences concurrently. Also finds the trial court erroneously treated the habitual offender sentencing enhancement as a separate offense. Remands for a corrected sentencing order.

Domestic relations. Affirms the grant of stepmother P.D.’s motion to intervene and the denial of her de facto custodian status, finding she was not the primary caregiver for A.P. and S.R.’s child. Finds Stepmother fails to show that the LaPorte Superior Court’s conclusion that she was not the child’s primary caregiver and de facto custodian is clearly erroneous.
