Charles Moon, Connie Moon, Daniel Short, and Heather Peters v. Denise Konkle

Civil plenary. Affirms Floyd Circuit Court Special Judge Jason Mount’s granting of summary judgment to Councilwoman Denise Konkle, after Charles Moon, Connie Moon, Daniel Short and Heather Peters brought a quo warranto action against Konkle, claiming she forfeited her office by residing in Harrison County for six months. Finds that the four relators lacked standing to bring a quo warranto action because they do not have a special interest in Konkle’s office. Also finds that because the relators lacked standing to bring the action, the appellate court will not address their Article 6, Section 6 residency argument. Attorney for appellants: S. Coy Travis. Anthony Xavier Carr v. State of Indiana

Criminal. Affirms a Lake County Superior Court’s jury finding Anthony Carr guilty of Brittany Smith’s murder and Judge Salvador Vasquez imposing an aggregate sentence of 68 years in prison. Finds that the trial court did not err in admitting into evidence the detective’s testimony that Carr was the only suspect and the text messages relating to a recent unrelated altercation between Smith and Carr. Also finds here is adequate evidence that Carr murdered Smith. Attorney for appellant: R. Brian Woodward. Elizabeth Gunther v. St. Joseph County Auditor and St. Joseph County Treasurer

Petition for tax deed. Affirms St. Joseph Circuit Court Judge John Broden’s denial of Elizabeth Gunther’s motion for an extension of time to record the tax deeds for three parcels of land she purchased at a tax sale. Finds the trial court lacked the authority to grant Gunther’s requested extension. Also finds Gunther has failed to demonstrate reversible error. Attorney for appellant: Ralph Sipes.
