The following opinion was posted after IL’s deadline Tuesday:
7th Circuit Court of Appeals
United States of America v. Keenan Seymour
23-1236
Criminal. Appeal from the United States District Court for the Northern District of Indiana, Hammond Division, Judge Philip Simon. Affirms the district court’s sentence of Keenan Seymour to 180 months in prison after he pleaded guilty to a Racketeer Influenced and Corrupt Organizations Act conspiracy charge. Finds the district court did not err when making certain factual findings and holding Seymour accountable for murder. Also finds the court considered each of the 18 U.S.C. § 3553(a) factors, including unwarranted disparities, and Seymour’s sentence is substantively reasonable.

Wednesday opinions

Indiana Court of Appeals
In the Matter of the Adoption of Baby Girl; C.M. and K.M., In the Matter of the Paternity of L.A. (Minor Child); Y.N. v. K.Q.A. and C.M. and K.M.
23A-AD-1590
Adoption. Reverses the Marion Superior Court’s order, which established Y.N.’s paternity of L.A. Finds that putative father’s consent to L.A.’s adoption had been irrevocably implied as a result of his failure to timely register with the registry and that he was, therefore, barred from challenging the adoption or establishing paternity. Also finds the trial court erred in entering an order establishing the putative father’s paternity.

In re the Termination of the Parent-Child Relationship of R.G. (Minor Child) and K.G. (Father), K.G. (Father) v. Indiana Department of Child Services (mem. dec.)
23A-JT-2430
Juvenile termination of parental rights. Affirms the Allen Superior Court’s termination of K.G.’s parental rights. Finds the father has taken few, if any, steps to improve himself as a person and parent, and he has not shown an ability to provide a safe and stable environment for the child. Also finds the evidence supports the court’s conclusion that termination is in the child’s best interests.

In the Matter of P.B., M.B., L.B., De.B., C.B., and Je.A. (Minor Children), Children in Need of Services and R.L. (Mother), D.B. (Father), and J.A. (Father) v. Indiana Department of Child Services (mem. dec.)
23A-JC-1994
Juvenile CHINS. Affirms the Wabash Circuit Court’s adjudication of P.B., M.B., L.B., De.B., C.B., and Je.A. as children in need of services. Finds there was sufficient evidence to support the trial court’s judgment that the children are CHINS.
