Reverses Clinton Circuit Court Special Judge Bruce Petit’s dismissal of Richard and Ashley Kelly’s lawsuit against Clinton County Prosecutor Anthony Sommer for defamation and emotional distress after Sommer spoke to the media about a State Board of Accounts review of the management of jail funds by Clinton County Sheriff Richard Kelly and his wife. Finds Sommer has not met his burden to obtain dismissal based on common law prosecutorial immunity. Attorney for appellant: Brian DeHem. Mortgage foreclosure. Reverses Dubois Superior Court Judge Anthony Quinn’s entry of a summary judgment order for G&I Realty LLC and the court’s denial of WBL’s motion for summary judgment. Finds G&I’s arguments and designations against WBL’s motion for summary judgment do not establish a genuine issue of material fact. Also finds WBL is entitled to summary judgment on its complaint for an in rem judgment and foreclosure against G&I. Remands for further proceedings consistent with the opinion.
